TERMS & CONDITIONS
These are the TERMS AND CONDITIONS that will apply when you purchase a website from MY FAMILY WEBSITE LIMITED . . . ( the small print !) Please read these Terms and Conditions before you order. They set out the terms on which MY FAMILY WEBSITE LIMITED will provide you with your website, and certain obligations imposed on you. DEFINITIONS The following words have these meanings :- Content" means text, graphics, logos, photographs, images, moving images, sound, illustrations, and any other Web Site content that we provide for your use. "Our" or "We" or "Us" means MY FAMILY WEBSITE LIMITED, whose registered office is at 29 Tamworth Street, Lichfield, Staffordshire, WS13 6JP, UNITED KINGDOM. "Privacy Policy" means our privacy policy. Please use the link below to view our privacy policy. "The Service" means any or all of the Website, support, domain name, and hosting packages provided by us "the Site" means the website found at www.myfamilywebsite.co.uk Support" means e-mail and telephone assistance provided by us to you. "Term" means a period commencing from the date your order is received.. "Your Website" means the Website created for you by us. |

1.. General Our Website at www.myfamilywebsite.co.uk is directed exclusively at individuals, families, clubs, societies and small businesses whether in the United Kingdom or elsewhere. In the event of the purchase being made by a business, you agree that all purchases made by you through the site are and will be made for purposes integral to your business and are and will be within the scope of your authority to conclude contracts on behalf of your business. 2. Your Website We will use all reasonable efforts to make the site available to you and exercise reasonable care in compiling the site. We will not be liable for any omissions, errors or exceptions contained within the site. We reserve the right at any time without notice to revise the content of the site. 3. Our Service During the term and provided that you supply us with the information we request when we request it in relation to each element of the service, then we will . . . a) use all reasonable efforts to provide the service to you with reasonable skill and care. b) use any personal information you give us in accordance with the terms of our Privacy Policy. We undertake to refund all monies paid for our service if you have a reasonable cause to be dissatisfied with the quality of the website within 7 days of the site going live on the server except that if our software detects that the site has been copied by you, we will assume that you have taken ownership and no refund will be made. We will provide you with a website which is hosted on a server for an agreed period. The Website will meet the requirements of the style option you have chosen. You may at any time during this term upgrade or downgrade the level of service that you receive. If you downgrade you may lose some content or images of your original website. 4. Limitations of Website content. We reserve the right to refuse to accept your order to produce a Website if the proposed content includes any material that is defamatory, unlawful, objectionable, pornographic, abusive, obscene, menacing, or in breach of confidence or privacy, or may cause inconvenience to others. We will not accept orders for Websites where the text, graphics or photographs supplied includes material of an explicitly adult nature and / or which involves gambling ( including lotteries and raffles). Your Website must not include material protected by intellectual property laws unless you own those rights or have received all necessary consents. 5. Domain name registration, masking, and transfer. i) Registering a new domain name We will provide you with a unique domain name as part of our service. You may apply to us to obtain a domain name of your choice for which an extra charge will be made, providing it is available. Unless otherwise agreed we will host your website on www.myfamilywebsite.co.uk/yourname. ii) Transferring a domain name. Where you already own a domain you must arrange redirection of the URL with or without masking to www.myfamilywebsite.co.uk/yourname. and we will not be able to arrange the hosting of your website until you have asked for it to be redirected to our server and that process is complete. We will use our best endeavours to assist you with this process. iii) Renewal of your domain name We undertake to assist with the renewal of your domain name at the second anniversary of the term. You will responsible for the cost of renewing your domain name. You will also be responsible for the renewal of any other domain names that you have purchased directly. iv) Your obligations You warrant that you are (or authorised by) the owner of any trade mark or name you wish to use on your Website. 6. Support We will provide a customer information help desk 9.00 am to 5.00 pm Monday to Friday (except UK Public Holidays) on 01543 373013 with calls charged at the normal BT rate from your area. 7. Limitations i) We do not warrant that access to your Website, or any part of it, will be uninterrupted, reliable or fault free, in accordance with the terms and condition of our supplier of hosting services. ii) We do not warrant to you that any information on the site will be accurate, complete or reliable. iii) To the extent permitted by law, we exclude all liability (whether arising in contract, tort or otherwise ) which we may otherwise have to you as a result of :- a) any technical, factual, textual or typographical inaccuracies, errors or omissions on or relating to the site or any information on the site. b) the unavailability of the site, or any part of it. c) any delay in providing, or failure to provide or make available the service or any negligent provision of the service. d) any misrepresentation on or relating to the site (other than a fraudulent misrepresentation made by us or on our behalf) iv) We do not accept liability for indirect or consequential losses, loss of data, income or profits or damages for loss of or damage to property. 8. Your obligations i) Charges a) You will make payments to us in advance for the service you have chosen b) We reserve the right to suspend or cancel any service provided by us in the event that you fail to meet your obligations to pay us within a certain time. ii) Security and Information a) You shall provide us with accurate and current information during the ordering process. b) You shall take responsibility for the security and proper use of passwords used in connection with the service and take all necessary steps to ensure that they are kept confidential and secure and are not disclosed to any unauthorised persons. iii) Your use of the service. a) You shall not take any action that may result in impairment to the service or render the service less functional or effective. b) Re-sell the service c) Use the service to transmit, store or knowingly or recklessly receive a computer virus. d) Allow us to publish on your behalf any content which you know to be illegal or unlawful including, without limitation, content which is defamatory or in breach of any rights of any person, including copyrights, trademarks, and rights of confidence or privacy, or contravenes the Data Protection Act 1998. e) Permit any third party to do any of the above. 9. Cancellation You may cancel this Agreement immediately on notice to us. We may terminate or suspend the service and / or this Agreement by immediate notice if you breach any term of this Agreement. On cancellation your right to use the software and the service shall cease immediately. 10. Suspension or alteration of Service i) We may at any time, without explanation, immediately suspend part or in an emergency all of the service for the purpose of maintaining or upgrading the service. ii) We may at any time, without explanation, change the services comprising the service if this is needed to comply with any applicable safety license or regulatory obligation or other statutory requirements or where the change does not materially detract from the quality or performance of the service. 11. Intellectual property i) All intellectual property rights we hold in the software and any material, accompanying documentation or content we provide to you for the purpose of using the service or in connection with the service will remain our property. ii) Other than is permitted by section 50B of the Copyright Designs and Patents Act 1988, you shall not :- a) Modify, adapt, translate, reverse engineer or disassemble the software or any material provided to you, or b) Copy, publish, re-transmit or distribute or otherwise reproduce the software or any material provided to you. 12. Copyright All rights in the design, text, graphics and other material on the site are the copyright of us, You may not electronically copy your Website, or any part of it. 13. Changes to these Terms and Conditions. We may at any time change the terms and conditions of this agreement on 30 days notice to you. Continued use of the service will signify that you agree to any such changes. 14. Governing law These terms and conditions shall be governed and construed in accordance with English Law and any disputes arising in relation thereto shall fall within the exclusive jurisdiction of the English Courts.
